These Terms of Service ("Terms") govern your use of the BlockSecOps platform and services.
1. Acceptance of Terms
By accessing or using BlockSecOps ("Service"), you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.
2. Description of Service
BlockSecOps provides:
- Smart contract security scanning and analysis
- Vulnerability detection and reporting
- API access for automated security testing
- Team collaboration features
- Integration with development workflows
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service.
3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
3.3 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information as needed.
4. Acceptable Use
4.1 Permitted Use
You may use the Service to:
- Scan smart contracts you own or have permission to analyze
- Integrate with your development and deployment pipelines
- Generate security reports for your projects
- Collaborate with team members on security assessments
4.2 Prohibited Use
You may NOT:
- Scan contracts without authorization from the owner
- Attempt to circumvent security measures or rate limits
- Use the Service for illegal activities
- Resell or redistribute the Service without authorization
- Reverse engineer or attempt to extract proprietary algorithms
- Use the Service to develop competing products

5. Subscription Plans
5.1 Free Plan
Limited functionality provided at no cost, subject to usage restrictions.
5.2 Paid Plans
- Developer, Startup, Professional, and Enterprise tiers
- Billed monthly or annually
- Features and limits as described on our pricing page
5.3 x402 Credits
- Pay-per-scan credits purchased with USDC on Base network
- Non-refundable once purchased
- Credits do not expire while your account is active
5.4 Payment Terms
- Paid plans are billed in advance
- Prices are in USD unless otherwise stated
- Taxes may apply based on your location
6. Cancellation and Refunds
6.1 Cancellation
- You may cancel your subscription at any time
- Access continues until the end of the current billing period
- No partial refunds for unused portions of the billing period
6.2 Refund Policy
- Refunds considered on a case-by-case basis
- Enterprise contracts may have specific refund terms
- x402 credits are non-refundable
6.3 Account Termination
We may terminate accounts that:
- Violate these Terms
- Engage in prohibited activities
- Remain inactive for extended periods (with notice)
7. Intellectual Property
7.1 Our Property
BlockSecOps owns all rights to:
- The platform and its underlying technology
- Scanner algorithms and vulnerability databases
- Documentation and training materials
- Trademarks and branding
7.2 Your Property
You retain all rights to:
- Smart contract code you upload
- Your proprietary security rules
- Reports and data you generate
7.3 License to Us
By uploading content, you grant us a limited license to:
- Process and analyze your code for providing the Service
- Store data as necessary for Service operation
- Generate aggregated, anonymized statistics
8. Data and Privacy
8.1 Data Collection
We collect data as described in our Privacy Policy.
8.2 Data Security
We implement industry-standard security measures as described in our Data Security Policy.
8.3 Data Retention
- Active account data retained while you use the Service
- Deleted account data purged within 30 days
- Audit logs retained per your plan's retention period
9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
9.2 No Guarantee
We do not guarantee that:
- The Service will find all vulnerabilities
- The Service will be uninterrupted or error-free
- Results will be complete or accurate
9.3 Your Responsibility
You acknowledge that:
- Security scanning is one part of a comprehensive security program
- Manual review remains necessary for critical contracts
- You are responsible for remediation decisions
10. Limitation of Liability
10.1 Exclusion
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOCKSECOPS SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Costs of procurement of substitute services
10.2 Cap on Liability
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
10.3 Exceptions
These limitations do not apply where prohibited by law.
11. Indemnification
You agree to indemnify and hold harmless BlockSecOps from claims, damages, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of third-party rights
- Code you upload or analyze
12. Changes to Terms
12.1 Updates
We may update these Terms from time to time. Changes will be posted with a new "Last Updated" date.
12.2 Notification
Material changes will be communicated via:
- Email to registered users

12.3 Acceptance
Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Dispute Resolution

These Terms are governed by the laws of Delaware, USA, without regard to conflict of law principles.

Disputes shall be resolved through binding arbitration, except for injunctive relief.

If any provision is found unenforceable, the remaining provisions remain in effect.

Failure to enforce any right does not constitute a waiver of that right.
14.4 Assignment
You may not assign your rights under these Terms without our consent.
